Chapter 4 - The Papers Tell the Story

Doctors diagnosed Rose with significant bruising and a sprained wrist but no fracture. Claire separately provided police with her account of using pepper spray.

Frank was not instantly imprisoned for financial crimes simply because of the hotel confrontation. The questions surrounding Mercer Senior Capital required a much broader investigation.

Over the following months, attorneys, regulators, accountants, and investigators examined Frank’s company and several affiliated entities connected to transactions involving clients like Rose.

Some investments were legitimate. Others did not appear to match how certain clients said those products, transfers, risks, or ownership structures had been represented.

Records raised questions about undisclosed conflicts, movement of client funds, unusual fees, and whether particular property transfers had been properly understood and authorized.

Relevant tax questions were referred to appropriate authorities, while clients pursued civil claims seeking recovery of money they believed had been improperly handled.

Frank denied intentionally defrauding anyone. His attorneys maintained that retirees had misunderstood complicated investment structures and agreements they had voluntarily chosen to enter.

The documents, however, told a more complicated story. Investigators compared signed agreements, recorded communications, emails, account histories, and the representations clients remembered receiving.

Rose’s condominium never transferred because she refused to sign Frank’s agreement that morning. Recovering her original eighty-five-thousand-dollar investment proved considerably more difficult.

Eventually, Rose recovered a substantial portion through settlements and asset-recovery efforts, although she did not receive every dollar she originally invested with Mercer Senior Capital.

That reality frustrated her. There was no dramatic suitcase filled with recovered cash and no single courtroom moment capable of undoing months of financial damage.

Claire reminded her of something important: “You saved your condo.” Rose smiled and asked, “What about my dignity?” Claire answered, “You never lost that.”
