Chapter 3 - Who Owns My House?
Martha immediately looked toward Daniel and demanded whether he knew about the transfer. Daniel appeared genuinely confused and told her he had known nothing.
Then Martha noticed Sarah standing silently beside him. Her expression hardened as she accused her daughter-in-law of secretly manipulating Robert before his death.
Andrew stepped between them and stated clearly that Sarah had not transferred anything. Martha demanded to know who now owned what she called her house.
Robert purchased the property before marrying Martha and retained separate title through their marital agreement and later estate documents, Andrew carefully explained.
For years, Martha behaved as though the entire Whitmore fortune belonged to her. Robert rarely corrected that impression publicly, but privately their relationship deteriorated.
During his illness, Robert became increasingly disturbed by Martha using inheritance threats to control Daniel’s decisions, particularly his marriage to Sarah.
Martha threatened to disinherit Daniel, pressured him to sign a postnuptial agreement, and later demanded restrictions preventing Sarah’s unborn child from receiving family money.
Robert refused. Three months before his death, he changed his estate plan after completing an independent capacity evaluation because he expected Martha would challenge it.
The mansion was transferred into the Whitmore Family Preservation Trust. Martha retained specific rights to live there, but she no longer personally owned the property.
“Who controls the trust?” Martha whispered. Andrew looked toward Daniel, whose eyes widened, then toward Sarah standing beside him with one hand over her belly.
Andrew clarified that the trust itself owned the mansion. Daniel and Sarah were successor co-trustees, subject to Robert’s detailed terms and independent oversight provisions.
Neither Daniel nor Sarah could simply throw Martha outside. Robert specifically protected her lifetime occupancy as long as she followed financial and maintenance requirements.
